First Chicago Bank & Trust (FCB&T) is committed to respecting your privacy. In accordance with federal regulations, FCB&T is giving you this notice to tell you how we may use information about you or your account. The following privacy policy and disclosure outlines what nonpublic personal information we collect, how we protect nonpublic personal information, and how we share nonpublic personal information. This notice also advises you of your right to keep certain information from being shared with other companies within and outside FCB&T and its affiliates. When we use the words “you” and “your” we mean all of our customers who have or have had a relationship with us.

I. Collection of information

We collect nonpublic personal information about you from the following sources:

• Information we receive from you on applications or other forms, such as your name, address, and telephone number;
• Information about your transactions with us, our affiliates, or nonaffiliated third parties, such as your account balances, payment history, and account activity;
• Information we receive from a consumer reporting agency, such as your credit bureau reports and other information relating to your creditworthiness; and
• Information we receive about you from other sources, such as your employer and other third parties.

II. Policies and Procedures to Protect Information

We restrict access to nonpublic personal information about you to those employees or servicers who need to know the information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information.

We strive to keep our records of our information about you accurate and up to date. If you tell us of an error, we will update our records promptly.

III. To Whom We May Disclose Nonpublic Personal Information

• We may share nonpublic personal information about you as described in Section I above with FCB&T affiliated companies (a company we own or control, a company that owns or controls us, or a company that is owned by the same company that owns or controls us). Affiliated companies with whom we may share this information include financial service providers, such as mortgage brokers and insurance companies.
• Companies outside the FCB&T family who may receive nonpublic personal information about you as described in Section I above, such as financial services providers and insurance agents.

We may also disclose nonpublic personal information about you as described in Section I above to nonaffiliated third parties as permitted or required by law, such as:

• Companies that perform marketing services or support services on our behalf necessary to effect and enforce transactions that you have requested or authorized;
• Joint marketing agreements with other financial institutions to offer financial products and services to you;
• To comply with a law, regulation, court order, or subpoena; and
• When otherwise permitted by law.

IV. How to Tell Us Not To Share Certain Nonpublic Personal Information (“Opting Out”)

a) If you tell us not to, we will not share your nonpublic personal information listed in Section I with companies outside the FCB&T family, except as permitted by law in certain circumstances, such as sharing information necessary to process and service your account.

b) If you tell us not to, we will not share with our affiliated companies information that you provide to us or that we obtain from third parties. As permitted by law, however, we may still share any information about our transactions or experiences with you to companies within the FCB&T family.

You may opt-out of either or both of (a) or (b) above by calling us toll free at 1-800-479-8077 and asking for the Compliance Department. Please note that if you have a joint account and decide to opt out, it will apply to all participants on the account.

Once we receive your request, we have a reasonable amount of time to stop sharing your nonpublic personal information.

FCB&T will continue to adhere to its disclosed privacy practices for an account even if it becomes inactive or is closed. This notice updates and replaces any previous privacy notices from FCB&T.
